1. General Provisions

1.1. These Terms of Service set out the rules for submitting inquiries and providing motion design services via the website.

1.2. Submitting the inquiry form constitutes acceptance of these Terms of Service.

1.3. Each order is priced individually based on the information provided by the Client.

2. Scope of Services

2.1. The Service Provider carries out motion design animation projects, in particular advertising animations, explainer videos, and visual materials.

2.2. The scope of work, timeline, and fee are agreed individually before the start of the project.

2.3. The Service Provider undertakes to carry out the project with due diligence and in accordance with the agreed terms.

3. Quality and Style of Execution

3.1. The Client accepts that the style, aesthetics, and quality level of the project correspond to the Service Provider's portfolio.

3.2. The portfolio serves as the benchmark for the Client's quality expectations.

3.3. The Service Provider does not guarantee alignment with subjective preferences of the Client that fall outside the presented style.

4. Liability for Marketing Results

4.1. The Service Provider is responsible solely for the quality of the project's execution.

4.2. The Service Provider is not liable for marketing results, including in particular:

  • number of views,
  • conversion rate,
  • sales,
  • effectiveness of advertising campaigns.

4.3. The ultimate use of the material and its effectiveness depend on the Client's actions and external factors.

5. Payments and First Installment

5.1. Work on the project begins without the need for an advance payment.

5.2. After completing an initial part of the project (e.g., concept, storyboard, animation excerpt, or first draft), the Service Provider presents it to the Client.

5.3. Payment of the first installment of the fee is a condition for continuing the project.

5.4. The first installment is non-refundable and constitutes payment for the work completed to date.

5.5. If the Client withdraws after the initial part of the project has been presented, the amount paid will not be refunded.

5.6. The remaining balance of the fee is payable before the final files are delivered, or as otherwise individually agreed.

6. Revisions and Changes

6.1. The project price includes a specified number of revision rounds (e.g., 2–3), agreed individually.

6.2. Additional revisions or changes beyond the agreed scope may incur additional costs.

6.3. Changes to the project assumptions after work has begun may result in changes to the timeline and pricing.

7. Delivery Timelines

7.1. The delivery timeline is agreed individually.

7.2. The timeline may change in the event of:

  • delays in the Client's delivery of materials,
  • lack of feedback from the Client,
  • changes to the project scope.

8. Materials Provided by the Client

8.1. The Client undertakes to provide all necessary materials (texts, logos, graphics, etc.).

8.2. The Client represents that they hold the rights to the materials provided.

8.3. The Service Provider is not liable for copyright infringements arising from materials supplied by the Client.

9. Copyright

9.1. Transfer of copyright to the project takes place upon payment of the full fee.

9.2. Until full payment is made, the project remains the property of the Service Provider.

9.3. The Service Provider reserves the right to use the project in its portfolio and for promotional purposes.

10. Contact and Communication

10.1. The primary form of communication is email or another agreed channel.

10.2. The Client undertakes to provide feedback in a timely manner.

11. Final Provisions

11.1. These Terms of Service may be amended.

11.2. Matters not regulated herein shall be governed by the laws of Poland.
